Neutral Citation No. - 2025:AHC-LKO:42402-DB Court No. - 9 Case :- CRIMINAL MISC. WRIT PETITION No. - 6421 of 2025 Petitioner :- Sanjay Kumar Respondent :- State Of U.P. Thru. Prin. Secy. Home Lko. And Others Counsel for Petitioner :- Shrawan Kumar,Sachida Nand Counsel for Respondent :- G.A. Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Brij Raj Singh,J. Heard learned counsel for the petitioner and learned A.G.A. for the State. This petition has been filed by the petitioner with the following main prayers : "(i) Issue a writ or direction in the nature of mandamus directing the opposite parties no.1 & 3 to not register the F.I.R. of the opposite party no.4 to 7 and their associates without prior inquiry, against the petitioner and his wife. (ii) Direct the opposite party no.1 & 2 set-up I inquiry about the first information reports lodged by the opposite party no.4 to 7 against the petitioner and his wife." Learned A.G.A. has raised a preliminary objection regarding the prayer no.1. He states that, for a litigant to be granted a prayer of mandamus, a subsisting legal right must be shown. There is no subsisting legal right of the petitioner to prohibit the respondents from registering any F.I.R. against him. Learned counsel for the petitioner says that the respondents have registered several F.I.R. against him only with the intention of extorting money. We find no good ground to interfere. The writ petition is, accordingly, dismissed. Order Date :- 22.7.2025/Mahesh Digitally signed by :- MAHESH KUMAR High Court of Judicature at Allahabad, Lucknow Bench
