The writ petition was heard yesterday and the entire order was dictated by me in open Court dismissing the writ petition. While correction, I found certain clarifications on facts are further required and the assistance of the State is also required. It is pertinent to note that yesterday, despite notice, the State was not represented. Accordingly, the order dictated by me in open Court dated April 7, 2025 stands recalled and the matter shall appear once again for further consideration under the heading “For Orders” on April 24, 2025. Since assistance is required from the State and if necessary by producing the record of the relevant criminal cases, Mr. N. C. Bihani, learned Senior Counsel with Mr. Sanatan Panja, learned State Advocate are requested to appear in the matter and hold the brief to assist this Court henceforth. Their appearance shall be
2 regularized by the office of the Legal Remembrancer forthwith. The petitioner shall serve a copy of the writ petition upon both the learned State Counsel by tomorrow. The order impugned in this writ petition at page 63 to the writ petition refers to four criminal cases which are : I. Sonarpur P.S. Case No.1987/15 II. Sonarpur P.S. Case No.84/16 III. Sonarpur P.S. Case No.974/16 IV. Sonarpur P.S. Case No.800/17
Mr. Ekramul Bari, learned Counsel appearing for the petitioner submits that in all the above four criminal cases the petitioner has been honourably acquitted. Learned State Counsel shall also take instruction whether any further criminal case is pending against the petitioner. If so, when the same was initiated and the status of it.
