Neutral Citation No. - 2025:AHC-LKO:41110 Court No. - 14 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 792 of 2025 Applicant :- Ajit @ Ajit Kumar Yadav And 3 Others Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. Counsel for Applicant :- Manish Kumar Yadav Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. The present anticipatory bail application has been filed seeking anticipatory bail in case crime/FIR No. FIR 0329/2023, Under Sections 323, 504, 506, 308 IPC, Police Station Loni katra, District Barabanki. Heard learned counsel for the applicant and learned A.G.A. for the State.
Learned counsel for the applicants submits that the allegations made in the FIR are general in nature and have been levelled against all the alleged assailants. It is further submitted that the charge sheet has already been filed and the applicant was not arrested during the course of investigation. It is argued that the applicant has been falsely implicated. On the other hand, learned A.G.A. has opposed the anticipatory bail application, submitting that four persons sustained injuries in the incident. Among them, a child named Kanishk, aged about five years, suffered a fracture in the left frontal bone. It is argued that the material on record does not support the contention of false implication, nor does it indicate that the applicant has been implicated with an intent to malign his reputation. Perused the record. A perusal of the case record shows that four individuals were
injured in the incident, including Kanishk, who, being a minor of about five years of age, suffered a fracture in his left frontal bone. The submission of the learned counsel for the applicant regarding false implication does not find support from the material on record. It does not appear to be a case of false implication. In view of the above facts and circumstances, no ground for grant of anticipatory bail is made out. The application is accordingly rejected.
