KAMAL ORAL ORDER Petitioner claiming to be owner in possession of the portion of the property bearing khata No.606 House List No.4/6, situated at Amani Byrathi Khane, Horamavu Panchayat, K.R.Pura Hobli, Bengaluru South Taluk measuring East to West 63 feet and North to South 119 feet, totally measuring 7497 Sq. ft. along with one AC sheet house having purchased the same from its previous owner in terms of deed of sale dated 04.08.1998 is before this Court seeking following reliefs: "(i) Quashing of preliminary Notification dated 03/02/2003 bearing No.BDA/Commr/ALAO/LA9/ 104/2002-03, at Annexure-A, and Revised Final Notification dated 18/06/2014 bearing No. UDD 426 MNJ 2011 at Annexure-B, so far as the land of the petitioner is concerned, and; - 3 - NC: 2025:KHC:4236 WP No. 9575 of 2019 (ii) Declare that the Notification dated 18/06/2014 vide Annexure-B as having lapsed under Section 27 of the BDA Act and Section 24(2) of the Right to Fair Compensation, Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, and (iii) Direct the respondents not to dispossess the petitioner from the Schedule Property". 2. 2. The aforesaid land, formed part of Sy.No.4/6 which has been acquired by the respondent -BDA for the purpose of formation of Arkavathi Layout. 3. Learned counsel for respondent-BDA at this juncture submits the grievance of the persons as that of the petitioner is being considered by the Committee headed by Hon'ble Justice Sri.K.N.Keshavanarayana and the petitioner may be relegated to the said Committee seeking redressal of his grievance. 4. In response learned counsel for the petitioner submits liberty be reserved to the petitioner to approach the said Committee and to seek redressal of his grievance in accordance with law. 5.
