Neutral Citation No. - 2025:AHC-LKO:42554-DB Court No. - 2 Case :- WRIT - C No. - 6725 of 2025 Petitioner :- Mujibunnisha Jahid Khan Respondent :- State Of U.P. Thru. Secy. Revenue Lko. And 4 Others Counsel for Petitioner :- Vinay Kumar Tiwari Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Rajan Roy,J. Hon'ble Manish Kumar,J. This petition has been filed with the following reliefs:
"to issue a writ, order or direction in the nature of Mandamus commanding the Opposite party No.2 and 3 to immediately halt the widening on or through Gata No.92 and to restrict the Opposite party no.4 from constructing directly from the middle of the petitioner's agricultural land without any lawful acquisition, consent, notice, or compensation in Village - Mustafabad, Tehsil - lalganj, District - Pratapgarh."
Learned Counsel has instruction that the land of the petitioner is not being encroached. The way out is for the petitioner to get the boundaries of his gata bearing No.92 demarcated under Section 24 of the U.P. Revenue Code, 2006, thereafter based on the result of the same, if there is a cause, then, seek appropriate remedy. In the event it is found that the road has been constructed on the petitioner's Bhumidhari land then obviously the Opposite Party no.4 or whosoever is responsible, will have to take correctional / remedial measure, failing which the petitioner can take recourse to appropriate remedies. The writ petition stands disposed of. . [Manish Kumar,J.] [Rajan Roy,J.]
