Heard learned counsel for petitioner and learned State Counsel for opposite parties. 2. Petition has been filed seeking a direction to concerned authority to consider and grant promotion to petitioner on the post of Rvenue Inspector from the date persons junior to him have been granted such promotion on 28.10.2024. Further prayer for grant of consequential service benefits including arrears of salary etc has also been sought. 3. It has been submitted that petitioner's consideration for promotion has not been made on account of previous punishment order dated 22.06.2022 which however has already been set aside subsequently vide order dated 03.02.2024 an aspect which has not been taken into consideration. 4. Since considering petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file fresh representation before opposite party no.2 i.e. The Commissioner and Secretary, Board of Revenue, U.P., Lucknow who shall consider and decide the same within a period of six weeks from the date a certified copy of this order is produced before the said authority along with fresh representation. 5. With aforesaid observations and directions, the petition is finally disposed of.
