2. The petitioner is apprehending his arrest in connection with Baharagora P.S. Case No.77 of 2024 for the alleged offences registered under Sections 303(2), 317(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, Sections 4, 21 and 22 of Mines and Minerals (Development & Regulation) Act, 1957, Rule 4/54 of Jharkhand Minor Mineral Concession Rules, 2004 and under Rule 7/13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017 pending in the Court of learned Judicial Magistrate 1st Class, Ghatsila.

Learned counsel appearing for the petitioner submits that the name of the petitioner has come on the statement of some of

the unknown villagers and the allegations are made of storing of 22,000 cft. of sand at the particular place. He submits that the petitioner has been granted anticipatory bail in identical situation in other two cases and the petitioner has received the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and has also replied the same.

Learned counsel appearing for the State opposes the prayer and submits that allegation is there of storing of 22,000 cft. of sand at the particular place.

Considering that the petitioner has complied the notice under Section 35(3) of Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner is directed to surrender before the learned Court within two weeks and the learned Court will release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
