learned counsel for the applicant and also heard Mr. D. Mozumdar, learned Senior counsel assisted by Mr. S. Das, learned counsel for the opposite party. Mr. Mozumdar, learned Senior counsel for the opposite party submits that he has no objection in the event of allowing this application under Order XLI Rule 27 of the Code of Civil Procedure, but the same has to be considered at the time of hearing of the appeal in terms of a decision of Hon'ble Supreme Court in the case of Union of India v. Ibrahim Uddin & Anr., reported in (2012) 8 SCC 148. Mr. Mozumdar also submits that the documents the applicant is willing to produce by filing this application are not relevant for the purpose of the appeal. Accordingly, taking note of the submission of learned counsel for both the parties, this interlocutory application stands allowed.
