Neutral Citation No. - 2025:AHC-LKO:41709 Court No. - 12 Case :- CRIMINAL REVISION DEFECTIVE No. - 353 of 2025 Revisionist :- Ankit Kumar Singh Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Another Counsel for Revisionist :- Kaushal Kishore Tewari,Shakti Counsel for Opposite Party :- G.A. Hon'ble Rajnish Kumar,J. C.M.Application No.1 of 2025 This is an application for condonation of delay in filing the revision. There is no objection by the other side. Having considered the submissions of learned counsel for the parties and grounds taken in the affidavit filed in support of the application, the delay is condoned. On Revision The sole argument advanced by learned counsel for the revisionist is that on account of matrimonial dispute there is chance of settlement between the parties, therefore, the matter may be referred to the Mediation and Conciliation Centre. This revision has been filed against the order of interim maintenance dated 29.11.2024 passed in Case No.1214/2023(Smt. Anshika Singh versus Ankit Singh) by the Additional Principal Judge, Family Court No.2, Sitapur under Section 125 Cr.P.C.. Thus the application under Section 125 Cr.P.C. filed by the respondent no.2 is still pending before the family court concerned. Therefore the family court itself can refer the matter to the mediation and conciliation centre of the family court, where an effort can be made for settlement of dispute. In view of above, the revision is dismissed with liberty to the revisionist to move an application for referring the matter to the mediation and conciliation centre before the family court concerned with an undertaking to pay the interim maintenance awarded by the family court w.e.f the date of order i.e. 29.12.2024. In case any such application is moved within a period of two weeks from today, the same shall be considered and decided within a period of two weeks thereafter by the concerned family court. Failing which, the court shall proceed in accordance with law. Order Date :- 22.7.2025 Akanksha Sri/- Digitally signed by :- AKANKSHA SRIVASTAVA High Court of Judicature at Allahabad, Lucknow Bench
