This is a petition under Article 226 of the Constitution of India for seeking the following relief(s): (i) Issue Rule upon the Respondents to show cause as to why Writ in the nature of mandamus and/or Order or direction/directions shall not be issued whereby directing the Respondents to issue Allotment Order in favour of the Petitioner No 1 in consequence of decision taken by Sub- Divisional Level Land Allotment Site Selection Committee on 02.12.2016, wherein the land allotment committee has given approval for allotment of land measuring 0.250 acres in favour of the Petitioner No 1. (ii) Make the rules absolute, (iii) Call for records (iv) Pass any further order/orders as this Hon'ble High Court considered fit and proper. [3]
It is the case of the petitioners that the petitioners filed this writ petition seeking necessary direction upon the respondents to issue Allotment Order in favour of the petitioner no 1 in consequence of decision taken by Sub- Divisional Level Land Allotment Site Selection Committee on 02.12.2016, wherein the land allotment committee has given approval for allotment of land measuring 0.250 acres in favour of the petitioner no 1. The Chairman, Ananda Marga School, Bishalgarh, Sipahijala, Tripura, alongwith the signatures of 278 Guardians of the students of the school and 25 signatures of Teachers and Committee members of the school, submitted an application to the District Magistrate & Collector, Bishramganj, Sipahijala, Tripura for getting allotment of Khas Land in favour of the petitioner no 1. Thereafter, the Sub-Divisional Level Land Allotment Site Selection Committee meeting
held on 02.12.2016, wherein the land allotment committee has given approval for allotment of land measuring 0.250 acres appertaining to hal plot No 6186, 6185 & 6183, having classified as Vitti (Nal) class of land recorded under Khatian No 1/220 of Mouja & T.K Bishalgarh in favour of Ananda Marga School (English Medium) i.e., the petitioner no 1. The Sub-Divisional Magistrate, Bishalgarh, Sepahijala District, vide letter, dated, 08.12.2016, send 1 no. of allotment proposal in favour of Ananda Marga (English Medium) at Bishalgarh, Sepahijala District i.e., the petitioner no 1 to the District Magistrate & Collector, Sepahijala District, Bishramganj.
In the letter, it is mentioned, that, the proposal for allotment of land was placed before the Sub- Divisional level site selection committee by circulation and the committee has given kind approval with premium. In the aforesaid letter, the Sub- Divisional Magistrate, Bishalgarh, Sepahijala District requested the District Magistrate & Collector, Sepahijala District, Bishramganj to take necessary action for allotment of land in favour of Ananda Marga (English Medium) i.e., the petitioner no 1. The petitioners on several occasions requested the District Magistrate & Collector, Sepahijala District, Bishramganj vide representation dated 28.08.2024 to accept the premium and allot land in favour of the petitioner no 1. But respondents are sitting idle over the matter. Hence the instant Writ Petition. [5]
In view of said submission, without expressing any opinion on the merits of the case, this present writ petition is disposed of directing the respondents to consider the case of the petitioners in accordance with law within a period of two months from the date of receipt of copy of this order. [6]
With the above observation and direction, this present writ petition stands
disposed of. As a sequel, stay, if any, stands vacated. Pending application(s), if any, also stands closed.
