1. This hearing has been done through hybrid mode. CM APPL. 57481/2025 (delay)
2. The present application under Section 5 of the Limitation Act seeks condonation of delay of 90 days in refilling after removing multiple defects. 3. In view of the averments made in the application, the same is allowed and disposed of accordingly. Delay of 90 days in refilling after removing multiple defects is hereby condoned. CM(M) 1768/2025
4. The present petition under Article 227 of the Constitution of India seeks following prayers:-
“a) My Lords may pass appropriate directions, order to the Ld. Addl. Judge Family Court, Dwarka Courts, New Delhi to dispose of proceedings in H.M.A no. 1551/2024 of Hindu Marriage Act, 1955, U/s 13(1) (ia)(ib) within time specified by this Hon'ble court preferably within 06 months from the date of orders; Or as an alternative This Hon'ble Court may send the parties for mediation settlement to ' dissolve the matrimonial relation and disputes; This is a digitally signed order. 5. Vide order dated 11.09.2025 petitioner was directed to place on record ordersheets of the learned Family Court. The same has been handed up in Court today and the same are taken on record. 6. A perusal of the ordersheets reflect that issues have been framed and the matter has been fixed for PE on 20.04.2026. Ordersheets also reflect that on account of defects an application under Order 6 Rule 17 of the CPC was filed on behalf of the petitioner for necessary amendment by adding a verification clause. 7. Perusal of the ordersheets reflect that the matter is proceeded towards the evidence. 8. In these circumstances, no specific directions are called for. 9. The present petition is disposed of accordingly. 10. Pending application(s), if any, also stand disposed of. 11.
Learned Trial Court is requested to proceed further in accordance with law as expeditiously as possible and without giving any undue adjournment to either of the parties. 12.
