Notice to opposite parties 4 to 7 stands dispensed with. Petition has been filed seeking following prayers:- " I. Issue a writ, order or direction in the nature of Mandamus for commanding the opposite parties no. 1 & 2 to promote the petitioner on the post of "Apiculturist / Entomologist" class -2, in 'Entomology Sub Section of Horticulture & Food Processing Department, Uttar Pradesh', as per direction of government order dated - 04 August, 2023, passed by opposite party no.-1 in compliance of orders dated 19.01.2023 & 16.5.2023, passed by this Hon'ble Court in Writ A No.482/2023 "Pradeep Srivastava & 9 Others Versus State of U.P. & Others" & Writ - A No. 3591 / 2023 "Ram Kumar Verma & 5 Others Versus State of U.P. & Others" and also as per final seniority list of "Subordinate Service Group - 3 (Application and Training Branch) Entomology Sub Section of said department, issued by opposite party no.- 2 vide order dated 16 August, 2023 (Contained as Annexure No.1 to this petition). II. Issue a writ, order or direction in the nature of Mandamus thereby command the opposite parties no.- 1 & 2 to restrain them for issuance of any further promotional order from the post of Subordinate Service Cadre Group - 1 & 2 post to "Apiculturist / Entomologist" class 2 post in "Entomology Sub Section of Horticulture & Food Processing Department until petitioner's claim for his promotion on Class - 2 post not be considered as per direction dated -04 August, 2023 passed by opposite party no.- 1, in that regard." It has been submitted that despite directions having been issued by the State Government regarding consideration of petitioner's services from the year 1993, his claim for such promotion has been ignored while issuing the same with regard to the private opposite parties. Since consideration of petitioner's grievances would factual aspects, liberty is granted to petitioner to make a fresh representation before opposite party No.2 i.e. Director, Horticulture & Food Processing Department, U.P. Lucknow or any other competent authority. In case such a representation is filed, the same is required to be decided after affording opportunity of hearing to all effected parties within a period of eight weeks from the date a certified copy of this order is produced before the said authority. The petition stands disposed of.
