GP for Women Development and Child Welfare The Court made the following order: Heard Sri T.V.V.Koteswara Rao, learned counsel for the petitioners and learned Assistant Government pleader for Women Development and Child Welfare appearing for the respondents. 2. The writ petition is filed challenging the action of the respondents in not considering the representation of the petitioners dated 08.04.2025 for extension of tenure of petitioners as the Chairperson and Members of the Andhra Pradesh State Commission for Protection of Child Rights. 2 3. It is contended by the petitioners that the 1st petitioner was appointed as Chairperson, and the other petitioners were appointed as Members of the Andhra Pradesh State Commission for Protection of Child Rights, vide G.O.Ms.No.6, dated 19.04.2022, issued by the Department for WCDA & SCs, Government of Andhra Pradesh. The tenure was for a period of three years, with effect from 22.04.2022. The petitioners made representations on 25.03.2025 and 08.04.2025 to the 1st respondent, requesting for extension of their tenure. It is further contended that the petitioners are eligible for reappointment under Section 19 of the Commissions for Protection of Child Rights Act, 2005. 4. It is also contended that in the State of Telangana, the tenure of the Chairperson and Members has been extended for another period of three years. Even in the State of Andhra Pradesh, extensions of up to six months have been granted in the case of Child Welfare Committees (CWCs). The learned counsel, therefore, requests the Court to pass similar order, as was passed in the Telangana, extending the tenure until the appointment of a new Chairperson and Members. 5. Today, when the matter is taken up for admission, the learned Assistant Government Pleader for Women Development and Child Welfare, appearing for the respondents, placed a copy of the written instructions received from the 1st respondent. A perusal of the same would reveal that issuance of the notification for appointing the Chairperson and Members to the State Commission for Protection of Child Rights, is under process. 3 6. Considered the rival submissions, the petitioners made representations to the respondents on 25.03.2025 and 08.04.2025. Immediately thereafter have filed the present writ petition on 10.04.2025, therefore, it cannot be said that there is any inaction on the part of the respondents in considering the representation of the petitioner. However, in the facts and circumstances of the case and considering that the petitioners' current tenure is expiring on 21.04.2025, and since the notification for the appointment of new Chairperson and Members has not yet been issued as of date, since the petitioner’s representation is pending before the authorities as of date, this Court deems it appropriate to dispose of the writ petition directing the 1st respondent to pass appropriate orders on the representations dated 25.03.2025 and 08.04.2025 filed by the petitioners. 7. With the above observations, the writ petition is disposed of. There shall be no order as to costs.
