NEAR VETARINARY HOSPITAL, ATCHAMPET POST AND MANDAL, GUNTUR DISTRICT. ...RESPONDENT(S): Counsel for the Petitioner: CHAKRAVARTHY P V S K Counsel for the Respondent(S): GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a writ order or direction more particularly one in the nature of writ of Mandamus declaring the actions of the respondent No 4 and 5 in not receiving the complaint dt 31012025 lodged by the petitioner and register the same for investigation in accordance with law as illegal arbitrary unreasonable contrary to the Article 14 19 21 of the constitution of India 3 Dr. YLR, J W.P.No.34483 of 2025 Dated 23.04.2026 and consequently directing the respondent No 4 and 5 to register the crime based on the complaint lodged by the petitioner dt 31012025 and pass….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3. Mr. P.V.S.K. Chakravarthy, learned counsel for the petitioner, submits that, even though the petitioner submitted a representation dated 31.01.2025 to the respondent police for registration of an FIR and to conduct an investigation, no action has been taken. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the respondent police conducted a preliminary enquiry on the representation submitted by the petitioner under Section 173(3) of ‘the BNSS’ and found that the nature of the allegations is civil in nature; therefore, the respondent police could not proceed further on the petitioner’s complaint. 5. Be that as it may, the petitioner has an alternative efficacious remedy by filing a private complaint before the learned jurisdictional Magistrate under Section 190 read with Section 200 of ‘the Cr.P.C.,’/Section 210 read with Section 223 of ‘the BNSS’. 6. Considering the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, requiring the petitioner to approach the learned jurisdictional Magistrate by way of filing an appropriate complaint under 4 Dr. YLR, J W.P.No.34483 of 2025 Dated 23.04.2026 Section 190 read with Section 200 of ‘the Cr.P.C.,’/Section 210 read with Section 223 of ‘the BNSS’, if so advised. 7. With the above observations and directions, the Writ Petition is disposed of. There shall be no order as to costs.
