And 5 Others Counsel for Petitioner :- Onkar Nath Tiwari Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Manish Kumar,J.
1. Heard.
2. Learned counsel for the petitioner alleges interference by the Police authorities in her possession despite the earlier order granted in favour of the private opposite parties by the Civil Court having been stayed in appeal by the District Judge.
3. The petitioner may move an application before the Circle Officer concerned who shall ensure that the Police authorities do not unnecessarily and illegally interfere in any civil dispute especially if it is pending before the Court concerned unless there is an order of the Court compliance of which has to be ensured.
4. We are not concerned with the private dispute between the petitioner and private opposite parties which is said to be pending in the District Court. We are only concerned with the interference of the police. In this regard, we observe/direct that the police shall come into picture only if there is an apprehension of breach of peace or apprehension of commission of any crime or it is actually committed or there are other valid grounds in any law/statue for their interference such as an order of the Court to be implemented, but, without interfering in the civil dispute between the parties.
5. With these observations, the writ petition is disposed of. [Manish Kumar, J.] [Rajan Roy,J] Order Date :- 17.7.2025/Ashish Digitally signed by :- ASHISH MISHRA High Court of Judicature at Allahabad, Lucknow Bench
