The present appeal has been filed seeking quashing of the order dated 22.05.2025, whereby an application filed by the appellant for recall of an order dated 17.03.2025 has been rejected. 3. The facts as evident are that an order dated 17.03.2025 came to be passed observing that the appellant is not cooperating with the decision of the appeal and observing his conduct on the prior dates, a cost of Rs.50,000/- was imposed upon the appellant. The appellant moved an application seeking recall of the said order stating that on account of the illness of the counsel, he could not appear, as such, imposition of the cost should be recalled. The said application has been rejected. 4. It is argued that the matter is fixed for decision on the appeal after about 10 days. 5. The present appeal is disposed of by observing that if the appellant cooperates in the hearing of the appeal on the next date fixed, the cost in question shall not be recovered. However, in case, if the appellant does not cooperate with hearing of the appeal, the order dated 17.03.2025 shall stand revive.
