Case of the prosecution, in brief is that on 21.02.2025, on receipt of credible informatI'On about illegal transportation of ganja, the Sub- lnspector of police along with his staff and mediators rushed to llth Jelly Fishing Harbour, I Town area, Visakhapatnam City and caught the accused in possession of 2 Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report. \ Eili:= . . . [3369] 3. Learned counsel for the petitioner contends that the pet'ltioner has been in judicial custody from 21.02.2025 and prays this Court to grant bail to the petitioner herein. 4. On the other hand, learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner on the ground that investigation in the present crime is not completed. 5. Heard. Perused the record. 6. Learned counsel for the petitioner submitted that the contraband alleged to be seized from the possession of accused is` 2 Kgs of ganja, which is not of commercial quantity. lt is submitted'that the petitioner had permanent abode and there is no possibility of his fleeing away from the justice. lt is submitted by the learned counsel for the petitioner that most of the witnesses are shown to be official witnesses and the release of the accused would not cause hampering of investigation and tampering of witnesses. lt is submitted by the learned Assistant Public Prosecutor that petitioner herein has involved in six other crimes. 7. ln view of the aforesaid'facts and circumstances of the case and since the contraband involved in the present crime is not a commercial quantity, this Court is inclined to grant bail to the petitioner herein. 8. ln the result, the criminal petition is allowed with the following I conditions: EEii i. The petitioner herein shall be released on bail on his executing a personal bond for Rs.20,000/- (Rupees twenty` thousand only) with two sureties for a like sum each to the satisfaction of the learned I AddI'tiOnal District & Sessions Judge-Gum-Special Judge for Trial of cases under the NDPS Act, Visakhapatnam. ii. On release, the petitioner shall appear before the Station House Officer concerned, twice in a week i.e., on every wednesday and Sunday between 10.00 AM and 01.00 PM.I for a period of four (4) months. iii.
