WP(C) 296/2025 Rozi Jan and Anr …Appellant/Petitioner(s) Through: None. Vs. Union Territory of J and K and Ors …Respondent (s) Through: Mr. Faheem Nisar Shah, GA.
CORAM:
HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE
ORDER 26.12.2025
1. This is a petition by the petitioners who claim to have contracted marriage out of their own free will and volition. Apparently both the petitioners are major and are capable of contracting such marriage. The petition has been filed on the apprehension that respondents 5 & 6, who are opposed to the marriage, may cause harm to the life and liberty of the petitioners.
2. This petition came up for consideration before this Court on 17th February, 2025, when this Court while issuing notice to the respondents directed the official respondents herein to provide necessary protection to the petitioners as and when they approach them for such assistance. The aforesaid order which was passed on 17th February, 2025, is still in operation.
3. It seems that petitioners, having taken benefit of the aforesaid order, are living together peacefully without any interference by the private respondents. Steps for service of respondents have been taken but the private respondents have chosen not to appear in the matter.
4. Be that as it may, having regard to the nature of the controversy involved, this petition is disposed of by directing that in case the petitioners still apprehend any threat to their life and liberty, they shall be free to approach the concerned police station for seeking protection. Needless to say that the police authorities, if approached by the petitioners in this regard, shall take remedial measures as are permissible in law so as to ensure the protection of their life and liberty.
5.
Disposed of.
