learned counsel for the applicant.

3. The present applicant Amit Singh is seeking bail in relation to FIR dated 11.02.2022 registered as FIR No. 130 of 2022 at P.S. Patel Nagar, District Dehradun wherein after investigation the present applicant has been charge sheeted for the offences punishable under Sections 420, 409, 467, 468 and 471 IPC.

Learned counsel for the applicant submits that the alleged incident is of the year 2019 when the applicant was posted as Branch Manager in Union Bank of India Branch at Niranjanpur, Dehradun. The allegation is with regard to opening of two fake accounts wherein an amount of Rs. 53 lakh and 48.50 lakh were credited. Learned counsel for the applicant submits that thereafter in the month of June 2021 the applicant was transferred to another Branch and new Branch Manager came over there and thereafter in the year 2022 an FIR has been lodged.

Learned counsel for the applicant further submits that twice the audit was done by the Audit Department first on 20.11.2019 and second one on 30.12.2020 and nothing adverse was found. He submits that in fact the Branch Manager without examining the
2025:UHC:1231 audit report lodged the FIR and in a very casual manner investigation was done and charge sheet was filed. He further submits that not only this, while submitting charge sheet the I.O. also not gone through with the audit report. Apart from this he submits that the applicant is languishing in jail since
01.11.2023.
6. Learned State Counsel have not disputed this fact that twice the audit was done but he submits that after thorough investigation charge sheet has been filed.
7. After hearing arguments of the
learned counsel for the parties and after gone through with the charge sheet and the FIR and further taking into consideration that twice the audit was done and nothing adverse was found, and charge sheet has already been filed and the trial is going and further the applicant has no criminal history, and he is languishing in jail since 01.11.2023, thus, without expressing any opinion on the merits of the case, this Court is of the view that the applicant deserves for bail. Accordingly, bail application is allowed.
8. Let the applicant Amit Singh be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
9. The bail application is disposed of finally.
