Mr. Dhiraj Thakur, Advocate, for respondent No.14 Mr. Aman Parth Advocate, for respondents No. 1 to 5, 7 to 11 & 13. Despite granting various opportunities the applicant has failed to take consequential steps qua respondents No. 6, therefore, appeal is abated qua the said respondent. It is contended by the learned counsel for the applicant that legal representatives of deceased respondent No.12 are already on record. Faced with above situation, learned counsel for the applicant prays for and is granted one week’s time to 0le appropriate application. The present application has been 0led for condonation of delay in 0ling the appeal. It has been averred in the application that the impugned judgment was passed by the learned District Judge, Bilaspur on 30.5.2024. After obtaining the legal opinion as sought by the o4ce of the applicant prompt immediate steps were taken to engage the counsel for 0ling an appeal. It has been contended by the learned counsel for the applicant that the delay in 0ling the appeal is neither
intentional nor willful and the same has occurred due to unavoidable circumstances, which were beyond the control of the applicant. Keeping in view the averments as made in the application, which is duly supported by an a4davit and in view of the submissions as made by the learned counsel for the applicant, the application is allowed and the delay of 215 days in 0ling of appeal is condoned subject to payment of cost of Rs.3500/- which shall be paid by the applicant to H.P. High Court Bar Association Welfare Fund positively within four weeks from today, failing which bene0t of the present order shall not be applicable to the present applicant.
