This petition under Article 227 of the Constitution of India has been filed seeking following main relief(s):- "To pass an appropriate order or direction, directing the learned Court of Additional District & Sessions Judge/Special Judge NDPS Act, Lucknow Misc. Case No. 141/2022 (Annexure-1) to consider and decide the application for released of account No. 3023000100337031 of petitioner no. 1 and account no. 3023000100285738 of petitioner no.2 operated in Punjab National Bank, Karaina Branch, Muzaffar Nagar, U.P., within stipulated time as directed by this Hon'ble Court and firstly decide the interim application forthwith." Learned counsel for the respondent, at the very outset, raised a preliminary objection regarding maintainability of this petition stating that the petitioner has a remedy under Section 529 of the B.N.S.S., 2023. On being confronted, after taking note of the aforesaid, learned counsel for the petitioner states that he may be permitted to withdraw the instant petition with liberty to the petitioners to avail the remedy as available under the law. Accordingly, the instant petition is dismissed as withdrawn with liberty, as prayed for. Office is directed to return certified copy of the papers/documents, if any, annexed with this petition to the learned counsel for the petitioners as per rules in this regard.
