The instant appeal is preferred against the judgment and order dated 14.09.2023 passed by learned Judge, Family Court, Vikasnagar, Dehradun in Case No. 196 of 2021, by which an application filed by respondent under Section 11 of the Hindu Marriage Act, 1955 has been decreed. 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the parties would submit that parties have arrived at a settlement and settlement has already been filed in a proceedings under Section 498-A IPC in the concerned court. Learned counsel would further submit that the respondent has already paid Rs. 1,00,000/- to the appellant and a cheque of Rs. 1,70,000/- is being paid today and the remaining amount of Rs. 1,00,000/- shall be paid by the respondent in the proceedings under Section 498-A IPC. 4. Learned counsel for the appellant would submit that he has received a cheque amounting to Rs. 1,70,000/-, but, it always remains subject to the bank honouring the cheque. 5. In view of the settlement arrived at between the parties, learned counsel for the appellant seeks permission to withdraw the appeal. 6. Permission is granted. 7.
