Heard learned counsel for the applicant and learned A.G.A. for the State-respondent. The present application for cancellation of bail has been filed by the applicant under Section 389 (2) of Cr.P.C. (now Section 430(2) of BNSS) for cancelling the bail granted to the accused/respondent No.2 by learned trial court in Criminal Appeal No.269 of 2024 arising out of Criminal Case No.4006925/2009 pertaining to Case Crime No.111/2008, under Sections 193, 467, 468, 471, 474 of IPC, P.S. Krishna Nagar, District Lucknow. After arguing for some time, learned counsel for the applicant submits that bail cancellation application may be dismissed as not pressed with liberty to file appropriate application before the learned trial court. In view of above, the bail cancellation application is dismissed as not pressed. However, it is provided that in case bail cancellation application is filed by the applicant before the trial court, the same shall be decided expeditiously. Office is directed to return the certified copies filed along with bail cancellation application to the learned counsel for the applicant.
