The Secy.Ministry Of Communications And I.T. Deptt.Of Posts, New Delhi. And 4 Others Counsel for Petitioner :- Onkar Nath Tiwari Counsel for Respondent :- A.S.G.I. Hon'ble Attau Rahman Masoodi,J. Hon'ble Shree Prakash Singh,J.
1. Heard learned counsel for the petitioner and Sri S.B. Pandey, learned Deputy Solicitor General of India assisted by Sri Varun Pandey, learned counsel appearing for Union of India.
2. By means of this writ petition, the petitioner has assailed the judgement/order dated 19.05.2025 passed by Central Administrative Tribunal, Lucknow in Original Application No.332/00052 of 2022 whereby the claim for deputation allowance as was set up by the petitioner has been rejected.
3. It is an admitted position of fact that the traveling allowance claimed by the petitioner for one hundred eighty days was duly redressed in terms of the rules in vogue. The claim of deputation allowance since was not admissible to the petitioner for he being deputed to work in the same very department has rightly been considered by the Tribunal in the light of relevant rules and the provisions applicable in this behalf.
4. The reasoning recorded by learned Tribunal in our humble
consideration does not call for any interference in exercise of writ jurisdiction under Article 226 of the Constitution of India.
5. The writ petition bereft of any merit is accordingly rejected. (Shree Prakash Singh,J.) (Attau Rahman Masoodi,J.)
