JUSTICE NELSON SAILO ORDER 26.06.2025 Heard Ms. K. Devi, learned counsel for the petitioner, who submits that the petitioner was appointed in Dakshin Moritoli Balak L.P. School, Morigaon, by the Managing Committee as an Assistant Teacher, which she joined on 05.01.2004. The petitioner passed her Higher Secondary Examination in the year 2012 and also completed Diploma in Elementary Education (D.El.Ed) in the year 2017-2019. Although the school was provincialised on 16.05.2013 but the petitioner was left out and it was shown that the post has been left vacant due to under qualification. 2. According to the petitioner, her name is shown in the DISE 2009-2010 and also in 2010-2011 of the SSA, Morigaon. Her representation was also forwarded by the District Elementary Education Officer, Morigaon to the Director of Elementary Education, Assam on 26.06.2020 but as the same has not been considered and no relief has been granted, the petitioner is before this Court. 3. Ms. K. Devi, learned counsel for the petitioner submits that the petitioner also filed representation on 19.06.2025 (Annexure 13) which remains unconsidered till date. 4. Mr. B. Kaushik, learned Standing Counsel, Elementary Education Assam appearing for respondent Nos.1 to 4 submits that since the representation of the petitioner is pending before the Director of Elementary Education, Assam, the same may be directed to be considered. 5. Having regard to the projection made by the petitioner and, more particularly, Page No.# 3/3 the pending representation submitted by her on 19.06.2025, the writ petition is disposed of with a direction to the Director of Elementary Education, Assam (respondent No.2) to consider and dispose of the representation submitted by the petitioner on 19.06.2025, as expeditiously as possible and preferably within a period of 4(four) weeks from the date of receipt of a certified copy of this order. 6. The petitioner shall also submit a copy of the writ petition along with a certified copy of this order before the respondent No.2 for doing the needful. JUDGE Comparing Assistant
