Case of the prosecution, in brief iS that On 21.03.2025, on receipt of credible information about illegal transportation of ganja, the Sub- Inspector 6f police along with his staff and mediators rushed tO backside of swatantra Nagar Sachivalayam, Madhurawada, and caught the accused in possession of 1.5 Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report. €<ft c}, ` .`. [3369] 3. Learned counsel for the petitioners contends that the petitioners have been in judicial custody from 21.03.2025 and prays this Court to grant bail to the petitioners herein. 4. On the other hand, learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioners on the ground that investigation in the present crime is not completed. 5. Heard. Perused the record. / 6. Learned counsel for the petitioners submitted that the contraband alleged to be seized from the possession of accused is 1.5 Kgs of ganja, which is not of commercial quantI'ty. lt iS Submitted that the Petitioners had permanent abode and there is no possibility of their fleeing away from the justice. It is submitted by the learned counsel for the petitioners {ha{ most of the witnesse.s are shown to be official witnesses and the release o'f the accused would not cause hampering of investigation and tampering of witnesses. lt is submitted by the learned Assistant Public Prosecutor that Al has involved in six other crimes. 7. ln view of the aforesaid facts and circumstances of the case and since the contraband involved in the present crime is not a commercial quantity, this Court is inclined to grant bail to the petitioners herein. 8. ln the result, the criminal petition is allowed with the following conditions: E=LiFFEiEE] =|= '? The petitioners herein shall be released on bail on their executing a personal bond for Rs.10,000/-(Rupees ten thousand only) each with two sureties for a like sum each to the satisfaction of the learned I Additional District & Sessi6ns Judge-Gum-special Judge for Trial of cases under the NDPS Act, Visakhapatnam. ii. on release, the lst petitioner/Al shall appear before the Station House Officer concerned, once in a week i.e., On every Sunday'between 10.00 AM and 01.00 PM., far a period of three (3) months. iii. on release, the petitioner Nos.2 to 4/A2 to A4 shall appear before the station House Officer concerned, once in a fortnight, for a period of three (3) months. iv.
