Chairman And 2 Others Counsel for Petitioner :- Km. Madhurima Bhargava,Deepshikha Sharma Counsel for Respondent :- C.S.C. Hon'ble Pankaj Bhatia,J. 1. Heard learned Counsel for the petitioner and learned Standing Counsel. 2. The present petition has been filed challenging an order dated 02.07.2025 whereby, directions were issued that in revision filed by the petitioner, Section 56 (1-A) of the Indian Stamp Act was mentioned which provides for an appeal against an order of assessment of stamp and there is a mandatory provisions for deposit of at least 1/3rd of the amount. 3. The Counsel for the petitioner states that from the memo of revision as well as the averments, it is clear that the revision was preferred, however, on account of typographical error Section 56 (1-A) was mentioned instead of Section 56 (1). 4. My attention has been drawn to the Indian Stamp Act wherein in Section 56, both the remedy is available i.e. the remedy of revision under Section 56 (1) as well as the remedy of appeal under Section 56 (1-A). 5. Considering the fact that from the prayer clause as well as the averments made in the application, it is clear that the petitioner had preferred a revision and not an appeal. The impugned order dated 02.07.2025 cannot be sustained and is accordingly set aside. 6. The writ petition is allowed with a direction to the Board of Revenue to decide the matter treating the same to be a revision filed under Section 56(1) of the Indian Stamp Act in accordance with law.
