Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Gopalpur P.S. Case No.188 of 2025 corresponding to C.T. Case No.818 of 2025 pending in the court of learned J.M.F.C.(R), Balasore on the grounds stated. 3. It is submitted to the Court that counter FIRs have been lodged against each other. The further submission is that no fatal injury has been caused to the victims. Pursuant to the Court’s order dated 23rd December, 2025, the case diary, statement of the witnesses besides medical examination report of the victim, namely, Narendra Mallik @ Pelua is produced and the same are gone through. The Court finds from the injury report that it is a laceration. In fact, a single injury has been received by the victim named above. In respect of the self-same incident, the petitioner lodged the FIR i.e. Annexure-2. Having regard to the above facts and nature of injury received by the informant/victim, this Court though not incline to grant pre- arrest bail to the petitioner, however, is in favour of directing him to be released on bail upon surrender before the learned court below with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before learned J.M.F.C.(R), Balasore within a fortnight from today in connection with C.T. Case No.818 of 2025 corresponding to Gopalpur P.S. Case No.188 of 2025, he shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. 6.
