Learned Counsel for the State has instructions that proceedings under Section 67(1) of the U.P. Revenue Code, 2006 have been initiated against the husband of the petitioner for encroachment upon 'banjar' land on which he has built the house. The petitioner before us is the wife. She claims benefit of Section 67-A, however, no such application has been filed before the competent authority, nor any other proceedings have been initiated. If any such application is preferred, the concerned authority shall consider and decide the same as per law, if it is maintainable and there is no legal impediment, or, the petitioner may avail other remedies as may be prescribed in law. The writ petition is accordingly disposed of.
