SANAGA ASHOK KUMAR The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the inaction on the part of the Respondents in not taking action against the 5th Respondent based on the report dated 20-09-2014 submitted by the Sub-Divisional 2 Police Officer, South Sub-Division, Guntur Urban, to the Superintendent of Police, Guntur Urban, Guntur District, pursuant to C.No.1932/G.1-RTI/2014, dt 14-03-2014, as illegal, arbitrary, and violation of the Fundamental Rights enshrined by the Constitution of India and to issue consequential Directions to Respondent Nos. 2 to 4 to take necessary and appropriate action against the 5th Respondent in accordance with the law.” 2. Sri Nuthalapati Mohan, learned counsel for the Petitioner would submit that the Sub-Divisional Police Officer, South Sub-Division, Guntur Urban submitted a report to the Superintendent of Police, Guntur Urban to initiate departmental enquiry against Respondent No.5, who is the errant Police Officer, but no action has been taken against him. 3. Sri V.Farooq, learned Assistant Government Pleader for Home, on instructions, would submit that, enquiry has been conducted and Respondent No.5 / Errant Police Officer was awarded with punishment. 4. Considering the submissions made, the Writ Petition is disposed of. There shall be no order as to costs.
