JUSTICE SANJEEV KUMAR SHARMA ORDER Date : 15 .09. 2025 Heard Mr. D.R. Saikia, learned counsel for the applicant and Ms. SH Bora, learned Addl. Public Prosecutor, Assam for the State respondent. This I.A. has been preferred by the applicant paying for condoning the delay of 51 days in preferring the connected appeal. It is stated that there is nobody else to help the applicant, except his wife Smti Sunomoni Bhaishya, who is also under the treatment of a doctor for an accident and the doctor advised Page No.# 3/3 her to take bed rest for 60 days wife effect from 30.04.2025 onwards as such she could not contract with the lawyer within the period but somehow she contacted the lawyer on 15.06.2025 for filling criminal appeal before this court and the learned lawyer also took few days to prepare the case of criminal appeal for filing the same before this Court which caused a delay of 51 days, which may be condoned. Having regard to the above, I find that the applicant has satisfactorily explained and has shown the sufficient grounds for condoning the delay of 51 days in preferring the connected appeal, which is accordingly condoned.
