ANJARIA and HON'BLE MR JUSTICE M.I.ARUN ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA) Contempt of Court is alleged in respect of the following directions, in particular, what is directed in paragraph 5 in order dated 08.08.2023 passed by learned Single Judge while disposing of Writ Petition No.15698 of 2021, "4. The petitioners have made application vide Annexures-K, L and M dated 05.07.2021 in this regard. In addition to above representations, petitioners are also permitted to file an additional representation highlighting their grievances regarding the order of suspension. If such an representation is made, respondent No.1 shall consider the same and dispose of the representation within a period of six weeks from the date of receipt of copy of this order. 5. It is also open to the petitioner No.3 to make a fresh representation regarding the payment of subsistence allowance. If such a representation is made, the same shall be considered by respondent No.1 within a period of six months and appropriate order be passed." 2. It was submitted that subsistence allowance is not paid and in that view, there is breach of the direction. The direction in - 4 - NC: 2025:KHC:3788-DB CCC No. 108 of 2024 paragraph 5 only required respondent No.1-the Director, Directorate of Sanskrit Education to decide the representation of the petitioners. 3. Memo dated 03.09.2024 is filed with which copy of the resolution dated 14.08.2024 passed in the meeting of the Karnataka Sanskrit University is produced which is in vernacular. 3.1 The translated copy, as produced, reads as under, "It is resolved to revoke the suspension of Siddharaj M, Vishwanath K and Parashiva P and ask them to report for duty and grant them subsistence allowance in accordance with the rules. Further, it was decided to direct the competent authority to conduct a departmental inquiry and take appropriate action." 4. The above resolution decides the representation of the complainants. Therefore, it can be said that the directions of learned Single Judge are complied with. 5. The contempt proceedings does not survive. They are disposed of. If the complainants have any grievance about the resolution or passing thereof, it is open for the complainants to institute - 5 - NC: 2025:KHC:3788-DB CCC No. 108 of 2024 appropriate independent proceedings, in respect of which this Court has not expressed any opinion on merits.
