Heard learned counsel for the parties.

This bail application under Section 483 & 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed to enlarge the petitioner on regular bail for offences under Sections 317(4) and 317(5) of the Bharatiya Nyaya Sanhita, 2023.

Learned counsel representing the petitioner submits that co-accused namely Munna Pandey, has already been enlarged on bail by a Coordinate Bench of this Court vide order dated 02.05.2025 in B.A. No.3406 of 2025 and the case of this petitioner is not distinguishable from that of the co-accused. She submits that the petitioner is languishing in jail since 12.02.2025. As such, he may be enlarged on bail.

Learned A.P.P. opposes the prayer for bail.

Having regard to the facts of the case and looking to the allegation made against this petitioner, so also the fact that co- accused has already been enlarged on bail by a Coordinate Bench of this Court, I am inclined to enlarge the petitioner on bail. Accordingly, the present Bail Application is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail

bond of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Godda, in connection with Pathargama P.S. Case No.24 of 2025.

It is made clear that till commencement of trial, the petitioner shall report to the local Police Station every month and after commencement of trial, he shall appear on each and every date before the learned Trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against this petitioner, learned Trial Court shall be at liberty to cancel the bail of this petitioner.
