An overview of the background facts of the case on hand is that an application came to be preferred by the private respondent – brother of the petitioner, before Tehsildar concerned for mutation of inheritance of the property, situate at village Malyarpora, Baramulla, left behind by his deceased father namely Ahad Sofi. The Tehsildar commenced the proceedings for attestation of inheritance mutation. Meanwhile, the petitioner preferred an application before Divisional Commissioner Kashmir, to carry out Intikal of land situate at Gulnar Park, Khaja Bagh Sherwai Colony and Azad Gunj Baramulla till family settlement with the shareholders. The Divisional Commissioner, vide impugned order dated 02.08.2021, forwarded/referred application of the petitioner to the concerned Tehsildar, being the competent authority, for attestation of mutation of inheritance, as per Muslim Personal Law, within one month and file action taken report. It is evident from the impugned order, passed by the Divisional Commissioner, that application preferred by the petitioner has been allowed and Tehsildar concerned, being the competent authority, has been directed to
proceed in accordance with law, in a time frame and submit the action taken report. I do not find any illegality or impropriety in the impugned order. Hence, present petition, being devoid of merit, is dismissed and impugned order is upheld.
Disposed of. Interim direction, if any, shall stand vacated.
