Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioners submits that the petitioners were arraigned as A.3 to A.5 and A.10 to A.14 in Crime No.25 of 2024 of Anandapuram Police Station, Visakhapatnam Commissionerate, Visakhapatnam District, registered for the alleged offence under Sections 220, 467, 468, 471 read with 120B of the Indian Penal Code, 1860. 3. The learned counsel further submits that the petitioners are facing similar allegations in Crime No.168 of 2019 based on the same set of allegations. After investigation, the police have filed a charge sheet, which was taken on file as C.C. No.250 of 2021. Subsequently, a second FIR was registered as Crime No.25 of 2024, wherein the petitioners were arraigned as A.3 to A.5 and A.10 to A.14 therein. The learned counsel for the 2nd respondent submits that the petitioners are facing trial in C.C. No.250 of 2021 before the XV Additional Metropolitan Magistrate, Bheemunipatnam. It is contended that the petitioner can raise all the grounds mentioned in the present quash petition before the trial court in C.C. No.250 of 2021. 3 CRL.P. No.4182 of 2025 4. From the material on record, it is evident that the police have registered a second FIR based on the same set of facts and circumstances. In these circumstances, this Court is of the considered opinion that crime No.25 of 2024 of Anandapuram Police Station, Visakhapatnam, is liable to be quashed. However, it is left open for the petitioners to raise all grounds mentioned in this quash petition before the trail court in C.C. No.250 of 2021 pending before the XV Additional Metropolitan Magistrate, Bheemunipatnam. 5. Accordingly, the criminal petition is disposed of. 6.
