The petitioner has filed this writ petition mainly with the following prayer: "i. Issue a writ order or direction in the nature of Certiorari quashing the impugned rejection order dated 27.10.2023 passed by District Leveled Committee as well as District Magistrate Lakhimpur Kheri on 27.10.2023 at Serial No.38 Kodi Lal Son of Shiv Dayal, R/o Saidpur, Karanpur, District-Lakhimpur Kheri contained Annexure No.1 to this writ petition. ii. Issue a writ order or direction in the nature of mandamus commanding to the District Leveled Committee to reconsider the claim of the petitioner, in the light of Government Order dated 28.02.2020 as contained in Annexure No.6 to this writ petition." The order impugned demonstrates that the petitioner died during treatment, which does not fall within the category of 'accidents which are covered by the Government Order dated 24.08.2020', contained in Annexure No. 6. No document has been filed to demonstrate that the deceased died as a consequence of an accident. The petitioner could not satisfy us. He had lodged an F.I.R. against opposite party No. 5/the doctor, but a final report was submitted therein, meaning thereby the allegation against the doctor had not been found to be true. No protest petition against the same was filed, as informed by learned counsel for the petitioner, therefore, it is not a case for interference. The writ petition is accordingly dismissed.
