The petitioner has moved before this Court for grant of privilege of anticipatory bail from apprehending his arrest in connection with Rajganj P.S. Case No. 08 of 2025 instituted under Sections 303 (2), 317 (2), 317 (5), 3 (5) of the B.N.S., 30 (2) of the Coal Mines Act, 4 / 21 of the Mine and Mineral (Regulation & Development) Act, 4/ 54 of the Jharkhand Minor Minerals Concession rule 2004 along with Sections 7 / 9/ 13 of the Jharkhand Minerals (Prevention of Illegal Mining, Transportation & Storage) Rules, 2017. 3. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has falsely been implicated in this case. The allegation against the petitioner is totally false and fabricated and he has not committed any offence. He further submits that nothing has been recovered from the conscious possession of the petitioner and most importantly, the petitioner was not found at the place of occurrence and his name is transpired in this case only on the basis of being the owner of the said vehicle. In fact, the allegation against the petitioner for transporting the coal illegally is a concocted story. Therefore, the petitioner may be released on bail. 4. Learned A.P.P. opposed the prayer of the petitioner for grant of bail. ( 2025:JHHC:14562 ) 2 5. Having regard to the facts and circumstances of this case, I am inclined to extend privilege of anticipatory bail to this petitioner. Accordingly, the petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty Thousand Only) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Dhanbad, in connection with Rajganj P.S. Case No. 08 of 2025. 6. It is made clear that petitioner shall co-operate with the investigation / trial. If the petitioner will not co-operate with the investigation / trial, the State would be at liberty to take appropriate action. (Deepak Roshan, J.) Aditi/Simran
