Heard learned Counsel for the petitioner. 2. The present petition has been filed with the following prayer: "Wherefore, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to direct to the Court of Civil Judge (Senior Division), Faizabad to decide the Application date 01/07/2025 filed by the petitioner under order 39 Rule 1 titled "Ram Narayan Chodhary vs Sarju Prasad" filed in regular suit no. 835/2025 pending before him, expeditiously as early as possible within a prescribe time, in the interest of justice. It is further prayed that this Hon'ble Court may kindly pleased to direct the opposite party not to create any third party right till the disposal of the interim relief application filed by the petitioner under order 39 Rule 1 titled "Ram Narayan Chodhary vs Sarju Prasad" filed in regular suit no. 835/2025 pending before the Civil Judge (Senior Division), Faizabad." 3. It is argued by the Counsel for the petitioner that the matter is fixed for 18.07.2025. 4. Considering the abovesaid fact, the petition is disposed off with a direction to the court concerned to pass order on the injunction application on the next date. 5. In case, the opposite party is not appearing, the trial court shall consider and pass orders, if a case for grant of ex-parte interim order is made out.
