[2025:RJ-JP:25020] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 5007/2025 Umrao Alias Kalu S/o Shri Ghisa Ram, Aged About 22 Years, R/o Tola Sehi, Police Station Surajgarh, District Jhunjhunu (Raj.). (At Present Confined In Dist. Jail Jhunjhunu). ----Applicant Versus The State Of Rajasthan, Through Pp ----Respondent For Applicant(s) : Mr. Upendra Singh Rathore Mr. Ravindra Kumar Paliwal For Respondent(s) : Mr. Naresh Kumar Gupta, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 08/07/2025 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.0289/2024 registered at Police Station-Surajgarh District Jhunjhunu, Rajasthan for the offence under Section 103(1) of the BNS, 2023. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Learned counsel further submits that the incident relates to 03.10.2024, while the statement of the witnesses were recorded on 10.10.2024. Therefore, on the basis of the statement recorded on 10.10.2024, the petitioner was arrested on 04.10.2024, much earlier than 10.10.2024. Petitioner has been booked for the offence of [2025:RJ-JP:25020] (2 of 2) [CRLMB-5007/2025] committing murder of deceased-Sandeep on false and concocted grounds. Learned counsel further contends that the petitioner is behind the bars since 04.10.2024 and charge-sheet has been filed. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence the bail application of the petitioner may be allowed. 4. On the contrary, learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially in backdrop of gravity of offence and without expressing any opinion on the merits/demerits of the case, I am not inclined to grant benefit of bail to the petitioner. 6. Accordingly, the bail application under Section 483 B.N.S.S. is dismissed. (PRAMIL KUMAR MATHUR),J MAHIMA/52
