1. Heard Mr.Ravi Kumar Bhagat, learned counsel for the petitioner. Also heard Mr.Y.S.Thakur, learned counsel appearing for respondents No.1 to 3/State, Mr.Kaushal Yadav, learned counsel appearing for respndent No.4 and Mr.Ramakant Mishra, learned Deputy Solicitor General appearing for respondents No.5 and 6. 2. The petitioner has filed this writ petition with the following reliefs:-
“I0.1 This Hon’ble Court may kindly be pleased to direct the respondent authorities to produce entire records pertaining to instant matter. 10.2 This Hon’ble Court may kindly be pleased to set aside the impugned action of respondent whereby the petitioner has been held ineligible and further to declare him eligible for the post of ‘Handpump Technician’ and to grant him
3 appointment on the aforesaid post with the respondent department. 10.3 This Hon’ble Court may kindly be pleased to set aside the selection of respondent No.4 and also the appointment order issued to respondent No.4 by respondent department.
10.4 This Hon’ble Court may kindly be pleased to declare ‘ultra-vires’ the scheduled III, clause 13 of ‘Chhattisgarh

Engineering Department (Non-Gazetted (Recruitment and Conditions of Service) Rules, 2016’ (column no.5, which provides for required educational qualification) of 2 year course certificate from Industrial Training Institute (IIT) in ‘Tractor Mechanical Trade” and substituted by it by ‘1 year’. 3. Learned counsel for the petitioner has submitted that the petitioner has already been selected, but he prays that prayer made in para 10.4 of the writ petition be decided. 4. Considering the fact that the petitioner’s grievance has been redressed, we leave it open that prayer made in para 10.4 of the writ petition be adjudicated in some other case.
