Petitioners claim right, interest and title in Gata No.87, however, the said Gata is recorded as Purani Parti. Khatauni is on record. Gata No.86 is recorded as Khaliyan. Petitioners say that there are 50 trees existing thereon which they have planted. 3. As regards the right and interest in land, we cannot determine the same under Article 226 of the Constitution of India. A suit has already been preferred by the petitioners seeking permanent injunction. If the petitioners claim title to the trees existing on any of the aforesaid Gatas, the remedy is under Section 58 of the U.P. Revenue Code, 2006. 4.
