The above said crime was registered against the petitioners herein and others for the offence punishable u/Sec.303(2) r/w 3(5), 49, 61(2) of t>-r`.. ll-I B.N.S and Sec.20(1)(d)(i)(a) I/w 20 (1 )(c) ill, ii'l, iv, X and Sec.36(a) r/w 32A of A.P. Forest (Amendment) Act, 2016. 3. The case of the prosecution in brief iS aSfOIIows: on o4,02.2025 at about 6.00 am, near Jarikona reserve forest, veeraballi Forest Beat, Sanipai section and range, the RSASTF staff found Al to A6 with 9 red sander logs Weighing about 281 kgs and 6 cell phones were seized from their possession. Then police apprehended Said Six persons and on enquiry, they d|lsclosed the'lr identity particulars as Al to A6,. pol'lce arrested them, seized the logs and vehicle. They confessed the involvement of A7 to A14 in the commission Of the Offence. 4, Learned counsel for the Petitioners contended that they have been 'ln judicial custody from o4.02.2025 and invest'lg?lion iS completed and POliCe filed charge sheet and prays to allow the criminal petition. 5. On the other hand, learned Assistant Public Prosecutor fairly submitted that the investigation is completed and police laid charge sheet but opposed to grant bail. 6. Heard both sides. 7. A perusal of material On record goes tO ShOWthatAl and A2 along with other accused were arrested and 9 red sander logs Were Seized. The petitioners have been in judicial custody from o4.02.2025. Without going into the facts of the case, as investigation is completed and charge sheet is c9iE- / also filed, further detention of the petitioners is no longer required. When ascertained, learned Assistant Public Prosecutor submitted that one antecedent reported against the petitioners. The petitioners have permanent abod'e at Tamilnadu State aS such there is no possibility of their fleeing away from justice. Most of the witnesseso are official witnesses and the release of the accused would not cause tamperihg of evidence and hampering of investigation. ln view of`the same, this Court is inclined to grant bail to the petitioners. 7. ln the result, the Criminal Petition is allowed with the f'ollowing conditions: - (i) The petitioners/Al and A2 herein shall be released on .their executing a personal bond for Rs.10,000/-(Rupees ten thousand only) each with two sureties for a like sum ea;h to the satisfaction of the learned Judicia-I Magistrate of First Class-Gum-Special Court for trial of cases relating to Red Sanders Smuggling, Tirupati; (ii) on release, the petitioners sha" appear before the station House Officer concerned on every Sunday between lO.00 a.m. and 12.OO noon, for a period of three (03) months; (iii) the petitioners shall not interfere in the investigation and they shall' not cause tampering of evidenc'e of hampering of investigation. . `,I. += -, . ."J||-- I lT Fi!uE' `'.€opy I I ASSISTANT Scf+ K.
