4. Petitioner is challenging the citation issued by Tehsildar, Kapkot, Bageshwar for recovery of Rs.9,45,408/-+other charges.
5. It is not in dispute that petitioner took a loan under a State Sponsored Scheme from Punjab National Bank, Branch Kapkot, Bageshwar in September, 2024, however, due to personal problems, he could not deposit the installments, in time, which had led to issuance of recovery certificate.

Learned counsel for the petitioner submits that petitioner is ready and willing to repay the loan, however, it is not possible for him to make repayment at once, therefore, he may be permitted to make repayment in one and half year.
7. Mr. Siddhartha Jain, learned counsel appearing for the bank, however, submits that if petitioner is ready to repay the loan in twelve monthly installments, then he has no objection, if he is permitted to do so, provided he
2025:UHC:10334 deposits some amount upfront to show his bonafide.

In view of the consensus between the parties, the writ petition is disposed of by permitting the petitioner to deposit Rs.50,000/- with the concerned branch of Punjab National Bank, within fifteen days from today. Subject to fulfilment of the aforesaid condition, petitioner shall be permitted to deposit the remaining amount in twelve equal monthly installments, quantum whereof shall be decided by the concerned Branch Manager. The last installment shall carry the component of interest, also. Subject to petitioner abiding the aforesaid conditions, the recovery citation issued against him, shall be kept in abeyance till
30.11.2026. However, in case of any default on the part of the petitioner, respondent shall be at liberty to proceed against him, as per law.
