1. Mr. Vikas Singh Yadav, learned counsel for the applicant.
2. Mr. Siddhartha Bisht, learned A.G.A. for the State.
3. Counter affidavit of the State is taken on record.
4. The present applicant ‘Jahoor’ is seeking regular bail in relation to Case Crime No. 21 of 2025 registered on the basis of First Information Report dated 07.01.2025 P.S. Laksar, District Haridwar, wherein, the present applicant has been implicated for the offence punishable under Section 8/22 of the NDPS Act.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and furthermore the alleged contraband, which was shown to be recovered from the possession of the present applicant, is below a commercial quantity.
6. He further submits that there is no proper compliance of the mandatory provision of Section 50 of the NDPS Act. He further submits that the applicant have no previous criminal history.
7. Learned A.G.A. for the State have not disputed this fact that the applicant have no previous criminal history and the alleged contraband, which was shown to be recovered from the possession of the present applicant, is below a commercial quantity.
8. After hearing the arguments of the learned counsel for the parties and further taking into
consideration that the alleged contraband, which was shown to be recovered from the possession of the present applicant, is below a commercial quantity and the applicant have no previous criminal history, this court is of the view that the applicant deserves for bail.
9. Accordingly, without expressing any opinion on the merit of the case the bail
2025:UHC:1615 application is allowed.
10. Let the applicant ‘Jahoor’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
11. It is also made clear that after being released on bail the applicant will cooperate with the investigation, failing which the concerned Investigating Officer is free to move bail cancellation application.
