Present petition has been filed challenging the order dated 20.05.2025 whereby the application under Order 7 Rule 11 of CPC was rejected observing that the issue as arisen in between the parties shall be decided after exchange of pleadings. 4. Considering the nature of the order passed, no interference is called for. 5. In case the petitioner is aggrieved, he can move an application for framing of fresh issues with regard to maintainability of the suit. In case any such application is filed, the same shall be considered on the next date of listing. 5. Present petition is dismissed in above terms.
