Neutral Citation No. - 2025:AHC-LKO:39210 Court No. - 18 Case :- WRIT - A No. - 7371 of 2025 Petitioner :- Pradeep Kumar Gautam Respondent :- State Of U.P. Thru. Addl. Chief Secy. Finance Lko And Another Counsel for Petitioner :- Pranendra Mirdha,Divya Yadav,Pranjali Mirdha,Ram Sagar,Shyam Kishor Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J.
1. Heard learned counsel for petitioner and learned State Counsel for opposite parties.
2. Supplementary affidavit filed today is taken on record.
3. Petition has been filed challenging order of transfer pertaining to petitioner dated 15th June, 2025 whereby he has been transferred on the post of Accountant from Lucknow to Farrukhabad. Also under challenge is the order dated Ist July, 2025 whereby petitioner's representation preferred in terms of directions issued earlier by this Court in Writ A No. 7058 of 2025, has been rejected.
4. Upon consideration of submissions advanced by learned counsel for parties, it is evident that primary ground taken by petitioner was ill health of his 86 years old father and 60 years old son who are said to be under medical treatment in Lucknow.
5. Perusal of impugned order dated Ist July, 2025 makes it evident that in terms of transfer policy from the year 2025-26, petitioner did not make any application for posting of his choice. The order also indicates that petitioner has been posted in the same district since the very inception of service since 23rd January, 1999. There is no corroborating evidence to indicate that illness of petitioner's father and son is of such a nature that can not be treated in place of transfer.
6. Transfer is an exigency of service and no violation of any statutory provision or any order having been demonstrated by the petitioner, this court does not find any doubt to interrupt any indulgence. The petition being devoid of merits is dismissed. Parties to bear their own cost.
