Dubga Mundu @ Sanika Mundu, son of Etwa Mundu All are residents of village Karika, P.O Sawaniya, P.S. Bandgaon, District- Singhbhum West. ...... Petitioner(s). Versus The State of Jharkhand. ….... Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Rajendra Pd. Gupta, Advocate. For the State : Mr. Naveen Kr. Ganjhu, A.P.P. …..... 03/23.06.2025: This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest for offences registered under Section(s) 8(b)/18 NDPS Act, in connection with Bandgaon P.S. Case No. 07/2025, pending in the Court of learned Sessions Judge, West Singhbhum at Chaibasa. Heard the parties at length and had gone through the documents, annexed along with this application. Opportunity was given to the State to oppose the bail, which they availed and opposed. It is alleged that the petitioners and others as well as Dhansa Mundu were cultivating poppy illegally in the land. Counsel for the petitioner submits that these petitioner are merely labourers working under Dhansa Mundu and the petitioners are not named in the FIR. Be that as it may, since there is allegation that poppy was being cultivated illegally, I am not inclined to allow this anticipatory bail application. Accordingly, the prayer for anticipatory bail of the petitioners, above named, is rejected. However, the petitioners are directed to appear before the Court concerned and file appropriate application taking the all pleas, which will be considered by the Court concerned and pass appropriate order.
