Petitioners are aggrieved by a notice dated 19.09.2025 issued by Sub- Divisional Magistrate, Bhagwanpur, District Haridwar. By the said notice, they have been called upon to show cause as to why they be not dispossessed from Government land, comprised in Khasra No. 426. 4. Learned State Counsel submits that the writ petition is premature and petitioners have the opportunity to have their say before Sub-Divisional Magistrate concerned. He further submits that the notice has been issued in terms of direction issued by this Court in WPMS No. 293 of 2022, whereby Sub-Divisional Magistrate was directed to get land comprised in Khasra No. 426 demarcated and also to ensure that encroachment over the said land is removed within six weeks. 5. Learned counsel for the petitioners submits that petitioners have submitted reply to the notice on 10.10.2025. 6. Having regard to the facts and circumstances of the case, the writ petition is disposed of with a direction to Sub-Divisional Magistrate concerned to 2025:UHC:9591 consider the reply submitted by petitioners and take appropriate decision, as per law, within eight weeks from the date of presentation of certified copy of this order. Till decision is taken in the matter by Sub-Divisional Magistrate concerned, petitioner shall not be dispossessed from the land in question.
