1. Proceedings of this matter have been taken through video conferencing. 2. The applicant has preferred this second application under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail in connection with Crime No.225/2024, registered at Police Station- Khamtarai, District Raipur, C.G. for the offence punishable under Section 20(B) of the NDPS Act. 3. 2 ‘ganja’ has seen seized and recovered from the possession of the applicant. 4. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submits that the Ganja has not been recovered from the conscious possession of the applicant. The applicant is 67 years old person and he is suffering from cataracts. The applicant is in jail since 19.03.2024. Therefore, he prays for grant of regular bail to the applicant. 5. On the other hand, learned State counsel for the non-applicant/State, would oppose the bail application of the applicant and submits that this is second bail application of the applicant and, his first bail application has been rejected by this Court vide order dated 28.06.2024. The trial is in progress and three witnesses have supported the case of the prosecution. Even otherwise, total 37.4 kg of Ganja has been seized from the applicant, which is more than commercial quantity, therefore he is not entitled for grant of regular bail. 6. I have heard learned counsel for the parties and perused the case diary. 7.
Considering the nature and gravity of the offence and material on record in the case diary and also considering the fact that this is second bail application of the applicant and, his first bail application has already been rejected by order dated 28.06.2024 and the trial
3 is in progress and three witnesses have supported the case of the prosecution and also considering the fact that total 37.4 kg of Ganja has been seized from the possession of the applicant, which is more than commercial quantity, therefore, I am not inclined to grant regular bail to the applicant.
