Learned counsel for the opposite party no. 2 has raised a preliminary objection that the applicant has challenged the validity of an order dated 30.01.2025 whereby the trial court has merely fixed a date for hearing submissions for taking cognizance of the offence. From the record, it does not appear that the trial court has taken cognizance of the offences and has summoned the applicant to face the trial. Therefore, the instant application is premature. Confronted with this objection, the learned counsel for the applicant states that he does not want to press the application. The application is dismissed accordingly.
